Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tnew application, the website at tnew.app, and any related services (collectively, "the Service"), operated by Jay Suh ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use Tnew. If you are under 18, you may only use the Service with the consent of a parent or legal guardian. By using Tnew you represent that you meet these requirements.

2. The Service

Tnew is a short-form video curation app where:

• Every post is verified to have been published within the last 24 hours.
• Every post auto-expires at the uploader's local midnight (±15 minutes).
• Source attribution and a link to the original platform are always shown.

We may add, remove, or change features at any time. We may suspend or discontinue the Service in whole or in part, with or without notice.

3. Accounts

• You are responsible for safeguarding your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information and update it when it changes.
• One account per person. Do not share, sell, or transfer your account.

4. Acceptable Use

You agree not to:

• Post content that is unlawful, defamatory, harassing, hateful, sexually explicit, or that exploits minors.
• Post content that infringes any copyright, trademark, right of publicity, or other intellectual property right.
• Post content that misrepresents its date or provenance, including re-uploads of older material claiming to be from today.
• Use the Service to send spam, scams, phishing, or malware.
• Attempt to reverse engineer, decompile, or extract source code from the Service.
• Use bots, scrapers, or automated tools to access the Service except through documented APIs.
• Interfere with, disrupt, or place excessive load on the Service.
• Bypass age, geographic, or content restrictions.

5. Your Content

5.1 Ownership

You retain ownership of any content you submit ("Your Content"). However, by posting Your Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and create derivative works of Your Content solely for the purpose of operating, promoting, and improving the Service.

5.2 Representations

You represent and warrant that:

• You own Your Content or have all necessary rights to submit it.
• Your Content does not infringe any third-party rights.
• Your Content was created or first published within 24 hours of the time you submit it (unless explicitly labeled as archive footage in clearly attributed news context).
• You will not submit content downloaded from another platform without rights.

5.3 Embedded content

When you share a link from YouTube, TikTok, Instagram, Vimeo, or other supported platforms, the original video continues to be hosted by that platform. We display only public metadata (title, channel, thumbnail) and an embedded player or link to the original. We are not the publisher of that content.

6. Content Moderation

• We may, at our sole discretion, remove or hide any content for any reason consistent with these Terms and applicable law.
• If three or more users report a post for violation of these Terms, we may hide it pending review.
• If we receive a copyright claim, we will follow our DMCA process (Section 7).

7. DMCA & Copyright

We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act ("DMCA").

7.1 To submit a notice

Send a written notice to jaysuh2020@gmail.com with the subject "DMCA Notice" containing:

• Your physical or electronic signature.
• A description of the copyrighted work you claim has been infringed.
• The URL or identifier of the post on Tnew.
• Your contact information (name, address, phone, email).
• A statement of good-faith belief that the use is not authorized.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the rights holder.

7.2 Counter-notification

If you believe content you posted was removed in error, you may submit a counter-notification with equivalent information. We follow the standard DMCA put-back timeline.

7.3 Repeat infringers

We terminate the accounts of repeat infringers. Strikes generally result in: (1) warning, (2) upload restriction, (3) account termination.

8. Third-Party Platforms

The Service displays content hosted on third-party platforms (YouTube, TikTok, Instagram, Vimeo, etc.). Your use of those platforms is governed by their respective terms and privacy policies. We are not responsible for third-party content, ads, or services.

9. Advertising & Affiliate Links

The Service may display third-party ads (through Google AdMob and similar networks) and contain affiliate links (through Skimlinks and similar networks) for which we may receive compensation. Affiliate-linked content is labeled where required.

10. Fees & Payments

Tnew is currently free to use. We reserve the right to introduce paid features in the future. Any paid features will be clearly disclosed before purchase.

11. Intellectual Property

The Tnew name, logo, app design, software, and original content (excluding Your Content and third-party embedded content) are owned by us and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works without our written permission.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in Los Angeles County, California, in English. The Federal Arbitration Act governs the interpretation and enforcement of this provision.

You waive the right to a jury trial and the right to participate in any class, collective, or representative action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing jaysuh2020@gmail.com with the subject "Arbitration Opt-Out".

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason consistent with these Terms or applicable law, including violation of these Terms, repeated copyright infringement, or fraud.

You may stop using the Service and delete your account at any time by emailing jaysuh2020@gmail.com.

16. Governing Law

These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict-of-laws principles. Any court proceedings (other than arbitration) shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

17. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, where the changes are material, notify you in-app or by email. Continued use of the Service after changes means you accept the updated Terms.
