These Terms of Service ("Terms") govern your access to and use of the Tnew application, the website at tnew.app, and any related services (collectively, "the Service"), operated by Jay Suh ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

However, by posting Your Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and create derivative works of Your Content solely for the purpose of operating, promoting, and improving the Service.

When you share a link from YouTube, TikTok, Instagram, Vimeo, or other supported platforms, the original video continues to be hosted by that platform. We display only public metadata (title, channel, thumbnail) and an embedded player or link to the original. We are not the publisher of that content.
We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act ("DMCA").

If you believe content you posted was removed in error, you may submit a counter-notification with equivalent information. We follow the standard DMCA put-back timeline.
We terminate the accounts of repeat infringers. Strikes generally result in: (1) warning, (2) upload restriction, (3) account termination.
The Service displays content hosted on third-party platforms (YouTube, TikTok, Instagram, Vimeo, etc.). Your use of those platforms is governed by their respective terms and privacy policies. We are not responsible for third-party content, ads, or services.
The Service may display third-party ads (through Google AdMob and similar networks) and contain affiliate links (through Skimlinks and similar networks) for which we may receive compensation. Affiliate-linked content is labeled where required.
Tnew is currently free to use. We reserve the right to introduce paid features in the future. Any paid features will be clearly disclosed before purchase.
The Tnew name, logo, app design, software, and original content (excluding Your Content and third-party embedded content) are owned by us and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works without our written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in Los Angeles County, California, in English. The Federal Arbitration Act governs the interpretation and enforcement of this provision.
You waive the right to a jury trial and the right to participate in any class, collective, or representative action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing jaysuh2020@gmail.com with the subject "Arbitration Opt-Out".
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason consistent with these Terms or applicable law, including violation of these Terms, repeated copyright infringement, or fraud.
You may stop using the Service and delete your account at any time by emailing jaysuh2020@gmail.com.
These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict-of-laws principles. Any court proceedings (other than arbitration) shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, where the changes are material, notify you in-app or by email. Continued use of the Service after changes means you accept the updated Terms.
